§ 21 AufenthG carries two very different routes. Paragraph (1) is the entrepreneur path: Gewerbe with economic interest, demand, financing proof. Paragraph (5) is the freelancer path: liberal professions per § 18 EStG (doctors, lawyers, architects, IT consultants, journalists, artists, translators). The documentation, evidence burden, and expectations diverge.

Entrepreneur route (§ 21 (1) AufenthG)

Detailed business plan in German (or with certified translation), market analysis, 3-year financial plan, funding proof (equity or bank commitment), IHK or chamber-of-crafts position letter. Ausländerbehörde and consulate assess: economic interest for the region, demand, feasibility. Typical funding proof €25,000 to €50,000+ depending on sector, though no statutory floor.

Freelancer route (§ 21 (5) AufenthG)

Liberal profession under § 18 EStG catalogue. Qualification documentation, licence where regulated (doctors, architects). Funding proof is simpler: signed client contracts, bank statements of €10,000 to €20,000 reserves. No IHK letter required.

Initial validity and settlement path

§ 21 (4) AufenthG allows initial grant up to 3 years. Settlement permit (Niederlassungserlaubnis) after 3 years if business is successful and livelihood is secured. Language requirements apply at settlement stage.

The § 21 (3) pension trap for applicants over 45

For applicants over 45, adequate retirement coverage is required. Commonly satisfied by private pension plan or equivalent foreign scheme showing retirement income projection. Many applicants miss this at filing; the case is rejected downstream.

Typical timeline

Business plan + IHK letter 2 to 6 weeks. Consulate D-visa 6 to 16 weeks. Arrival + Ausländerbehörde title 2 to 8 weeks. End-to-end 4 to 8 months. Munich KVR is typically faster than Berlin LEA.

Frequently asked questions

What is the difference between § 21 (1) and § 21 (5) AufenthG?

§ 21 (1): entrepreneur Gewerbe with business plan, IHK letter, funding. § 21 (5): freelancer freie-Berufe with qualification and client contracts.

How much money do I need in the bank for a German self-employed visa?

No statutory floor. Practical: €25,000-€50,000+ for Gewerbe (§ 21 (1)), €10,000-€20,000 reserves for freelancer (§ 21 (5)).

Do I need a business plan for the § 21 (5) freelancer route?

No. Client contracts and qualification evidence are enough.

What counts as a "freie Beruf" under § 18 EStG?

Doctors, lawyers, architects, engineers, IT consultants in consultancy role, journalists, artists, translators, and the catalogue of similar professions.

Can a digital nomad get a § 21 visa?

Freelancer route (§ 21 (5)) fits if qualification and client contracts evidence liberal-profession activity. Pure remote employment does not qualify; that is a work-permit case.

How long is the initial self-employed residence permit valid?

Up to 3 years per § 21 (4) AufenthG. Often issued shorter initially (1 to 3 years) depending on plausibility.

When can I apply for a settlement permit as a founder?

After 3 years if business is successful and livelihood secured, under § 21 (4) AufenthG.

What is the pension-provision requirement for applicants over 45?

§ 21 (3) AufenthG: adequate retirement coverage must be demonstrated. Private pension plan or equivalent foreign scheme with projected retirement income.

How long does the consulate visa process take in practice?

6 to 16 weeks. IHK pre-consultation speeds it in some cases.

Do I have to form a GmbH or can I just register a Gewerbe?

Either works. Einzelunternehmen + Gewerbeanmeldung is simpler; GmbH adds liability shield. Many founders do both: GmbH as operating vehicle + § 21 (1) visa for the Geschäftsführer.

Can my spouse and children come with me on family reunification?

Yes. Spouse and minor children can apply under family-reunification rules; German language requirement applies to spouse unless exempted.

What health insurance must I carry during the application?

Private or statutory health insurance certificate covering the full application period.

Can I change my business focus after I receive the permit?

Yes, but material shifts should be disclosed to Ausländerbehörde. Permit was issued on the basis of the business plan; drifts can trigger review.

What happens if my business underperforms in year 1 or 2?

Extensions depend on continued viability. We typically reposition the plan at year-2 renewal if numbers fell short; complete failure risks non-extension.
